Ces deux traits fondamentaux n\u2019ont pas \u00e9t\u00e9 modifi\u00e9s par la directive sur les services en cours de transposition. Cette derni\u00e8re reprend la jurisprudence de la Cour de justice des communaut\u00e9s europ\u00e9ennes (CJCE) tout en r\u00e9duisant les possibilit\u00e9s d\u2019intervention des \u00c9tats dans le domaine de la libert\u00e9 d\u2019\u00e9tablissement. La directive services n\u2019est donc ni un changement de politique ni un \u00ab&nbsp;retour du politique&nbsp;\u00bb.
